Set out below is the legal framework underpinning competition damages claims along with a consideration of some issues faced when pursuing competition litigation in the courts of England and Wales. A frequent issue facing claimants is the choice of forum in which an international or European dispute should be heard and the law applicable to that dispute. England is increasingly becoming an attractive jurisdiction to hear competition disputes, with a recent judgment confirming England as a ‘friendly forum’.
